Update…

Derek (Kermit)has done it again. When I confronted him, he responded to me and made a substitution offer to resolve the problem.  On Oct 17th he said he was mailing out the replacements and he would send me proof. For a wk I asked him for the proof and he said he would it out that day. Well its been almost a month now and he wont reply. I fell for it again.
