Toys R Us Class Action Settlement Offer

A settlement has been proposed in a class action lawsuit pending against Toys “R” Us, Inc. and Toys “R” Us-Delaware, Inc (“Toys “R” Us”), which owns and operates Babies “R” Us, Babiesrus.com, Toys “R” Us andToysrus.com.

The Action alleges that Toys “R” Us engaged in unlawful business practices by failing to provide full refunds for merchandise credit to customers who returned gifts to a retail store that were purchased through the internet. Toys “R” Us denies that it has done anything wrong, and denies that any Class Member has been injured or suffered damages. After analyzing the claims and defenses in this Action, and taking into account the risks and uncertainty inherent in a trial and appeals relating to the Action, the parties have concluded that it is in their respective best interests to settle the Action on the terms summarized in this Notice.

Those Class Members for whom Toys “R” Us can determine from their records timely returned to a retail store gifts purchased over the internet from Babies “R” Us, Babiesrus.com, Toys “R” Us or Toysrus.com and did not receive full merchandise credit refunds, shall automatically receive by e-mail or First Class Mail a $5 Merchandise Certificate to be used at any Babies “R” Us or Toys “R” Us retail store or online at Babiesrus.com or Toysrus.com.

These Class Members also have the option of making a Claim for the actual amount shorted after a gift return, which is equal to the purchase price of the item returned less the actual amount previously refunded. To exercise this option, Class Members need to provide their contact information, some transaction information, and mark the box on the Claim Form electing to receive a Merchandise Certificate for the actual amount shorted after a gift return in lieu of the $5 Merchandise Certificate.

Basically if you are aggrieved and cannot find your receipt, TRU will offer a $5 gift certificate redeemable at TRU or BRU.

If you do have your receipt or some transaction #, TRU will refund you the actual amount in question.

    Another annoying thing about buying from TRU.com is that you cannot get a refund if you return something. Only a store credit, even with receipts. They wont credit the credit card used to make purchase. So make sure its exactly what you wanted!!!!

        Maybe I’ll send you my returns next time!!! Out here in NJ they have signs on the service desk stating that tru.com purchases will only be returned as store credit. I was pretty annoyed when I couldn’t get the proper refund. I had never heard of such a thing with internet returns before. Logged a complaint to home office, but haven’t heard anything back except the form letter sorry for your troubles responses…

        Perhaps it is a regional policy thing.

        But what is surprising is that TRU is now allowing No Receipt returns. Have to present Driver’s License. You are allowed $75 worth of receiptless returns in a 13 month period according to my local store.

          It is Toys R Us policy to only issue merchandise credit when online orders are returned in-store. To get a refund, you have to ship it back. Of course, you have to pay to ship it back, and Toys R Us knows this, so they take advantage of the customer.

          It’s a lame policy, and I learned about it last night when trying to return an online order to a store, but it is listed on their website.

          But it definitely ensures that I won’t be ordering from Toys R Us again, or shopping in their stores. I’ll deal with retailers who are more customer-centric.

    Almost seems like a marketing ploy. Here, we will send you a $5 dollar gift card and you can come in and put this $5 credit towards all your toy Christmas gifts.
